1 Validity of the GTC
DillySocks AG provides all deliveries and services on the basis of the following GTC and the provisions listed here: https://www.iubenda.com/terms-and-conditions/73025751
These GTC are valid for an indefinite period of time, as long as they have not been amended by the parties in writing. In all other respects, the provisions of the Swiss Code of Obligations on sales contracts and other Swiss laws and ordinances shall apply. Should a provision of these GTC be invalid or should a loophole exist, this shall not affect the legal validity of the remaining provisions. In place of the invalid provision, a valid provision shall be deemed to have been agreed from the outset which comes closest to the economic intention of the parties. The same applies in the event of a loophole.
2. offer and conclusion of contract
All offers made by DillySocks AG are non-binding and merely represent an invitation to the customer to submit a binding offer to conclude a purchase contract for the goods presented in the online shop. The contract is concluded upon acceptance of the order. The confirmation from DillySocks AG is decisive for the scope and execution of the delivery. DillySocks AG is entitled to withdraw from the contract in cases of obvious typing and invoicing errors.
3 Prices and shipping costs
The prices stated in the online shop are non-binding and can be adjusted by DillySocks AG at any time. All prices include the statutory value added tax. Shipping and packaging costs are listed separately under "Shipping" in the footer. For deliveries outside Switzerland, the customer is responsible for any taxes and customs duties incurred.
4 Delivery and delivery times
Deliveries are made after credit card payment in the online shop, to the delivery address specified by the customer in the order. DillySocks AG is not liable for delays. The risk is transferred to the customer when the goods are dispatched.
6 Warranty & right of return
If defects in delivered goods are documented by the customer, the customer has the right to choose between a replacement delivery or cancellation of the purchase. If the goods cannot be replaced, the cancellation of the purchase shall take effect. Excluded from the warranty are defects and faults for which DillySocks AG is not responsible, such as natural wear and tear, force majeure, improper handling, intervention by the customer or third parties, excessive use or extreme environmental influences.
The delivered goods will be taken back by DillySocks AG within 30 days of receipt, provided the goods are unused and the packaging and labels are undamaged. The shipping costs for the return will be borne by the customer. Upon receipt of the goods by DillySocks AG, the goods will be exchanged or the purchase price refunded at the customer's request. The shipping costs incurred when ordering will not be refunded.
DillySocks AG reserves the right to refuse returns if the returned goods are not in the above-mentioned condition.
If the customer resells the products, he is responsible for compliance with domestic and foreign export regulations. If the customer modifies the resold products, he is liable to DillySocks AG, the buyer or third parties for any resulting damage. The provisions of the Product Liability Act remain reserved.
7 Security and data protection
Customer data will be treated confidentially in accordance with Swiss data protection legislation.
8. final provisions
The place of jurisdiction is the registered office of DillySocks AG. However, DillySocks AG may also appeal to the court at the customer's domicile. Swiss law shall apply exclusively, even if orders are placed from abroad or deliveries are made abroad. The parties shall endeavour to settle any disputes arising from the execution of this contract amicably. These General Terms and Conditions of Business shall be deemed to have been accepted upon the ordering of goods by the customer. Changes or additions to the general terms and conditions are made exclusively by DillySocks AG. These must be made in writing.
